Planning your nikah in New Jersey? Most couples want one ceremony that is both religious and legal. In the US that is normally possible: an imam who is authorized to marry couples can lead your nikah and sign your marriage license in the same sitting. Here is how it works in New Jersey, in plain language.

The short answer

Apply for a New Jersey marriage license at a municipal registrar, who issues it 72 hours after you apply. Then hold your nikah within 30 days of issue with an authorized imam and at least two witnesses. He signs the license and files it with the registrar, and your marriage is legally recorded.

What makes a marriage legal in New Jersey

  • A marriage license. Apply at the registrar's office of the municipality where either of you lives, bringing valid photo ID. Both of you normally attend.
  • A 72-hour wait to issue. The registrar will not issue the license until 72 hours after you apply. Once it is issued you can marry right away.
  • A 30-day window. The license expires 30 days after it is issued. This is much shorter than most states, so time your application carefully.
  • Two witnesses and an authorized officiant. New Jersey requires at least two witnesses at the ceremony. Clergy of any religious denomination may solemnize the marriage, and they return the signed license to the registrar.

None of this changes the nikah itself. Your imam leads the khutbah, the consent, the mahr, the offer and acceptance and the dua exactly as he otherwise would, and takes care of the civil paperwork at the same time.

Getting a marriage license in New Jersey

Apply in person at the registrar of vital statistics in the municipality where one of you lives. The state fee is $28, so check with your registrar for any local charges. Many offices work by appointment.

Plan around the two time limits: the registrar issues the license 72 hours after you apply, and you then have 30 days to hold the ceremony. Most couples apply one to three weeks before the nikah.

Can your imam sign a New Jersey marriage license?

Many imams in New Jersey can sign marriage licenses as clergy of their mosque or Islamic center. Others perform the religious ceremony only. Ask before you book: can you sign a New Jersey marriage license?

The ceremony witnesses can usually be the same two Muslim witnesses who witness the nikah. Confirm with your registrar.

After the ceremony

After the ceremony the imam completes the license and files it promptly with the registrar of the municipality where the ceremony took place. The marriage is then recorded and you can order certified copies of your marriage certificate.

What a religious-only nikah does and does not give you

Religiously, a great deal. You are married in your faith, your contract and mahr are binding between you, and your community recognizes the marriage. Some couples choose this on purpose, for example while one partner is still waiting on immigration or documents.

Legally, an unregistered nikah leaves you unmarried. That usually means no automatic spousal property rights, no automatic inheritance if one of you dies without a will, no spousal health insurance, and trouble with immigration and benefits that ask for a marriage certificate.

New Jersey does not create a marriage just because a couple lives together, so a nikah without a license and registration leaves you legally unmarried there. Do not rely on living together as a substitute for registering the marriage.

Write down the mahr

Agree the mahr before the day and record it in your nikah contract, including how much is given now and how much is deferred. A clear written agreement protects you both.
