Planning your nikah in Maryland? Most couples want one ceremony that is both religious and legal. In the US that is normally possible: an imam who is authorized to marry couples can lead your nikah and sign your marriage license in the same sitting. Here is how it works in Maryland, in plain language.

The short answer

Get a Maryland marriage license from the circuit court clerk of the county where you will marry, wait about two days until it takes effect, then hold your nikah within six months with an imam who is authorized to perform marriages. He signs it and returns it to the clerk.

What makes a marriage legal in Maryland

  • A marriage license. Apply at the circuit court clerk's office of the county where the ceremony will take place. Bring valid ID and proof of age, and check whether both of you need to appear.
  • A 48-hour wait. A Maryland marriage license takes effect at 6 a.m. on the second calendar day after it is issued, so the ceremony cannot happen sooner. A circuit court judge can allow earlier effect for good cause in limited cases.
  • A six-month window. The ceremony must take place within six months after the license becomes effective.
  • An authorized officiant. Clergy of a religious organization can solemnize a marriage in Maryland. Your imam signs the license after the ceremony.

None of this changes the nikah itself. Your imam leads the khutbah, the consent, the mahr, the offer and acceptance and the dua exactly as he otherwise would, and takes care of the civil paperwork at the same time.

Getting a marriage license in Maryland

Apply to the circuit court clerk of the county where the ceremony will take place. If you live elsewhere, ask the clerk about completing an affidavit. Fees vary by county, so check the clerk's website for the current amount.

Maryland, Virginia and DC have different rules, and many couples in the DC area live near all three. Make sure your license is for the state and county where the nikah takes place.

Can your imam sign a Maryland marriage license?

Many imams in Baltimore and the Maryland suburbs of DC can sign marriage licenses through their mosque or Islamic center, and others perform the religious ceremony only. Ask before booking: can you sign a Maryland marriage license?

If not, you can complete the civil marriage separately and keep the nikah as the religious ceremony.

After the ceremony

After the ceremony the imam gives one certificate to you and returns the other to the clerk who issued the license, within 5 days. The marriage is recorded and you can order certified copies of your marriage certificate.

What a religious-only nikah does and does not give you

Religiously, a great deal. You are married in your faith, your contract and mahr are binding between you, and your community recognizes the marriage. Some couples choose this on purpose, for example while one partner is still waiting on immigration or documents.

Legally, an unregistered nikah leaves you unmarried. That usually means no automatic spousal property rights, no automatic inheritance if one of you dies without a will, no spousal health insurance, and trouble with immigration and benefits that ask for a marriage certificate.

Maryland does not create a marriage just because a couple lives together, so a nikah without a license and registration leaves you legally unmarried there. Do not rely on living together as a substitute for registering the marriage.

Write down the mahr

Agree the mahr before the day and record it in your nikah contract, including how much is given now and how much is deferred. A clear written agreement protects you both.
