Planning your nikah in Florida? Most couples want one ceremony that is both religious and legal. In the US that is normally possible: an imam who is authorized to marry couples can lead your nikah and sign your marriage license in the same sitting. Here is how it works in Florida, in plain language.

The short answer

Get a Florida marriage license from any county clerk of court, then hold your nikah within 60 days with an imam who is authorized to perform marriages. He signs the license and returns it to the clerk. Florida residents who skip the premarital course face a three-day wait.

What makes a marriage legal in Florida

  • A marriage license. Both of you apply together at a county clerk of court with valid photo ID. The license is valid anywhere in Florida.
  • The premarital course and waiting period. Florida residents who complete a state-approved premarital preparation course of at least four hours lower the license fee and skip the three-day waiting period. Couples who do not take the course wait three days if either of you is a Florida resident. If both of you are non-residents there is no waiting period.
  • A 60-day window. The license is valid for 60 days after it is issued.
  • An authorized officiant. Ordained ministers and other clergy can solemnize a marriage in Florida. Your imam signs the license after the ceremony.

None of this changes the nikah itself. Your imam leads the khutbah, the consent, the mahr, the offer and acceptance and the dua exactly as he otherwise would, and takes care of the civil paperwork at the same time.

Getting a marriage license in Florida

You can apply at any county clerk of court, and the license can be used in any county. Fees are listed by each clerk, and the premarital course lowers the fee. Check your clerk's website for the current amount and appointment rules.

If you plan to take the course, finish it before applying and bring the certificate. Many providers offer it online in a few hours.

Can your imam sign a Florida marriage license?

Many imams across South Florida, Orlando, Tampa and Jacksonville can sign marriage licenses as clergy of their mosque or Islamic center. Others perform the religious ceremony only. Ask before booking: can you sign a Florida marriage license?

Florida also allows notaries public to solemnize marriages, which some couples use for the civil side while an imam leads the nikah.

After the ceremony

After the ceremony the imam completes the license and returns it to the clerk who issued it. The clerk records the marriage, and you can order certified copies of your marriage certificate for name changes, insurance and immigration.

What a religious-only nikah does and does not give you

Religiously, a great deal. You are married in your faith, your contract and mahr are binding between you, and your community recognizes the marriage. Some couples choose this on purpose, for example while one partner is still waiting on immigration or documents.

Legally, an unregistered nikah leaves you unmarried. That usually means no automatic spousal property rights, no automatic inheritance if one of you dies without a will, no spousal health insurance, and trouble with immigration and benefits that ask for a marriage certificate.

Florida no longer recognizes new common-law marriages, so living together does not make you married there. A nikah without a license and registration leaves you legally unmarried.

Write down the mahr

Agree the mahr before the day and record it in your nikah contract, including how much is given now and how much is deferred. A clear written agreement protects you both. Our mahr calculator can help you settle on an amount, and our step-by-step guide to the nikah ceremony explains each part of the day.

A few common questions

Is a nikah legally binding in Florida?
A nikah is legally binding in Florida when you have a valid Florida marriage license and an authorized officiant performs the ceremony and returns the signed license to the clerk. Otherwise it is a religious marriage only.
Is there a waiting period for a Florida marriage license?
If either of you is a Florida resident and you do not complete a premarital course, you wait three days. Completing the course skips the wait and lowers the fee, and couples who are both non-residents have no wait. The license is valid for 60 days.
Can an imam sign a Florida marriage license?
