Nikah in California: How to Make Your Islamic Marriage Legal
Published October 16, 2026

Planning your nikah in California? Most couples want one ceremony that is both religious and legal. In the US that is normally possible: an imam who is authorized to marry couples can lead your nikah and sign your marriage license in the same sitting. Here is how it works in California, in plain language.
The short answer
Get a California marriage license from a county clerk-recorder, then hold your nikah within 90 days with an imam who is authorized to solemnize marriages. He signs the license and returns it to the county, and your marriage is legally recorded. There is no waiting period and no blood test.
What makes a marriage legal in California
- A marriage license. Both of you normally appear together at a county clerk-recorder's office with photo ID. California offers a public license and a confidential license (see below).
- No waiting period. You can marry the same day the license is issued. The license is valid for 90 days.
- An authorized officiant. California law allows a priest, minister, rabbi or authorized person of any religious denomination who is at least 18 to solemnize a marriage. Your imam signs the license after the ceremony.
- Return of the license. The signed license must be returned to the county that issued it within 10 days of the ceremony.
None of this changes the nikah itself. Your imam leads the khutbah, the consent, the mahr, the offer and acceptance and the dua exactly as he otherwise would, and takes care of the civil paperwork at the same time.
Getting a marriage license in California
You can apply at any county clerk-recorder in the state, and the license is generally valid in every California county (confirm with your clerk). Many counties let you begin the application online and then confirm in person. Fees are set by each county, so check your clerk's website for the current amount and whether you need an appointment.
A public license needs at least one witness at the ceremony. A confidential license needs no witnesses, but it is only available to couples who already live together as spouses. Because the nikah itself requires the wali and two Muslim witnesses, many families choose the public license.
Can your imam sign a California marriage license?
Many California imams can sign marriage licenses through their mosque or Islamic center. Others perform the religious ceremony only. Before booking, simply ask: are you authorized to solemnize marriages in California and sign the license?
If your imam cannot sign, you still have options. You can complete the civil marriage separately at the county office or with another authorized officiant, and keep the nikah as the religious ceremony.
After the ceremony
After the ceremony the imam completes the license and returns it to the county clerk-recorder within 10 days. The county records the marriage, and you can order certified copies of your marriage certificate, which you will need for name changes, insurance and immigration.
What a religious-only nikah does and does not give you
Religiously, a great deal. You are married in your faith, your contract and mahr are binding between you, and your community recognizes the marriage. Some couples choose this on purpose, for example while one partner is still waiting on immigration or documents.
Legally, an unregistered nikah leaves you unmarried. That usually means no automatic spousal property rights, no automatic inheritance if one of you dies without a will, no spousal health insurance, and trouble with immigration and benefits that ask for a marriage certificate.
California does not create a marriage just because a couple lives together, so a nikah without a license and registration leaves you legally unmarried there. Do not rely on living together as a substitute for registering the marriage.
Write down the mahr
Agree the mahr before the day and record it in your nikah contract, including how much is given now and how much is deferred. A clear written agreement protects you both.
